Death Compensation Process

Providing assistance in processing death compensation claims for deceased Sri Lankan migrant workers by liaising with employers, relevant government authorities, insurance providers, financial institutions, and other concerned organizations in the Republic of Korea to secure statutory compensation, insurance benefits, outstanding salaries, severance pay, pension benefits, bank balances, and other employment-related entitlements.

Upon receipt of the required documents from the legal heirs/next of kin (NOK) in Sri Lanka through the Ministry of Foreign Affairs, the Embassy verifies and forwards the documents to the relevant authorities to facilitate the processing and payment of death compensation and other entitlements to the rightful beneficiaries, while coordinating with the next of kin and the relevant authorities in both Sri Lanka and the Republic of Korea until the settlement of the claims. 

The required documents may vary depending on the circumstances of each case; however, the documents listed below are the basic documents initially required.

1. A Power of Attorney, authorizing the Embassy to act on behalf of the legal heirs for the purpose of claiming insurance benefits, compensation, and/or bank balances (if any) – in English. 
2. A Legal Heir Certificate, issued by an Attorney-at-Law, confirming the legal heirs of the deceased – in English. 
3. A sworn affidavit signed by all legal heirs, expressing their consent for the insurance benefits, compensation, and/or bank balances (if any) payable in respect of the deceased to be released to the nominated beneficiary – in English. 
4. A copy of the bank passbook of the beneficiary together with a bank certification letter issued by the respective bank confirming the account details. The certification must clearly indicate the account holder's full name, account number, SWIFT code, and branch code – in English. 
5. Details of any bank accounts maintained by the deceased in the Republic of Korea, including the name of the bank and the account number, if available. 
6. A copy of the National Identity Card (NIC) of the beneficiary together with a detailed extract (or certified detailed copy) – in English. 
7. A copy of the National Identity Card (NIC) of the deceased together with a detailed extract (or certified detailed copy) – in English. 
8. If the deceased was married, a copy of the Marriage Certificate, translated into English. 
9. If the deceased was unmarried, a copy of the Birth Certificate, translated into English. 
10. Two (02) original Powers of Attorney authorizing Samsung Fire & Marine Insurance Co., Ltd. – in English.

• The documents referred to under Items i, ii, and iii, prepared in English, and the document referred to under Item viii /ix , translated into English, must be authenticated by the Consular Affairs Division of the Ministry of Foreign Affairs of Sri Lanka. 

• The names of all persons appearing in the above documents must be stated accurately and consistently in every document, exactly as they appear in the detailed English copy of the National Identity Card (NIC) issued by the Department for Registration of Persons. 

• When translating information into English, particularly personal names, the spelling must be consistent throughout all documents. 

• The full name, date of birth, and all other particulars of the beneficiary entitled to receive the compensation must be identical in all the above documents. If there are any discrepancies, however minor, a sworn affidavit explaining such discrepancies must be submitted. 

• If additional documents are required during the processing of the compensation claim, apart from those listed above, the applicant will be informed accordingly on a case-by-case basis.
